1.1 These general terms and conditions ("GTC") regulate the use of the VoiceBooker ("Platform") platform, via which users can create, manage and integrate VoiceBots/VoiceAgents into booking or similar systems.
1.2 By registering on the platform and using its services, the user accepts these GTC.
1.3 Deviating regulations only apply if they have been agreed in writing.
2.1 The platform offers tools for creating, configuring and integrating VoiceBots/VoiceAgents ("Services").
2.2 The platform provides API interfaces and other integration methods to integrate VoiceBots into external booking and customer management systems.
2.3 The availability of the platform is regulated by a service level agreement (SLA), unless otherwise agreed.
2.4 The platform may offer additional paid services such as training data optimization, advanced analyses or support packages.
3.1 In order to use the platform, the user must create an account and provide the required information truthfully.
3.2 The user is responsible for the confidentiality of his access data and is liable for all activities carried out under his account.
3.3 The platform reserves the right to block or delete user accounts if these terms and conditions are violated.
4.1 The user undertakes not to use the platform for illegal purposes.
4.2 It is prohibited to manipulate, overload or circumvent security mechanisms on the platform.
4.3 The user ensures that all VoiceBots created with the platform do not distribute content that violates applicable law, the rights of third parties or these terms and conditions.
5.1 Use of the platform may be associated with free or paid tariffs, which are specified in the user agreement or on the platform.
5.2 All prices are exclusive of applicable VAT unless otherwise stated.
5.3 The user agrees to pay any fees incurred on time. In the event of late payment, the platform reserves the right to restrict or block access to paid functions.
6.1 The user retains ownership of the VoiceBots he has created, provided that they were developed with his own content.
6.2 The user grants the platform a simple, non-transferable right to use his VoiceBots and their data, insofar as this is necessary for the provision of the agreed services.
6.3 The user guarantees that he has all the necessary rights to the content he uses via the platform.
7.1 The platform is provided "as is". No guarantee is given for the freedom from errors or suitability for specific purposes.
7.2 The platform is not liable for indirect damages, lost profits or loss of data unless these result from intent or gross negligence.
7.3 The platform's liability is limited to the amount that the user paid to the platform in the last 12 months before the damage occurred.
8.1 The platform processes the user's personal data in accordance with its data protection declaration and the applicable data protection laws.
8.2 The user is responsible for complying with the data protection requirements when using his VoiceBots.
9.1 The user can terminate his contract with the platform at any time in writing or via the function provided for this purpose on the platform.
9.2 The platform can terminate the contract with 30 days' notice. In the event of a breach of the General Terms and Conditions, termination may occur without notice.
9.3 After termination of the contract, the user no longer has access to his VoiceBots or stored data.
10.1 The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
10.2 Should individual provisions of these General Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected.
10.3 The place of jurisdiction for all disputes arising from or in connection with these General Terms and Conditions is Dresden.
In all other respects, the Data processing agreement applies to providers.
